This paper takes the dichotomy between “exclusive” and “inclusive” positivism and applies it by analogy to natural-law theories. With John Finnis, and with Beyleved and Brownsword, we have examples of “exclusive natural-law theory,” on which approach the law is valid only if its content satisfies a normative monological moral theory. The discourse theories of Alexy and Habermas are seen instead as “inclusive natural-law theories,” in which the positive law is a constitutive moment in that it identifies moral rules and specifies (...) their meaning. The current assessment of behaviors in the inventories to diagnose autism spectrum disorders (ASD) focus on observation and discrete categorizations. Behaviors require movements, yet measurements of physical movements are seldom included. Their inclusion however, could provide an objective characterization of behavior to help unveil interactions between the peripheral and the central nervous systems. Such interactions are critical for the development and maintenance of spontaneous autonomy, self-regulation and voluntary control. At present, current approaches cannot deal with the heterogeneous, dynamic and stochastic (...) nature of development. Accordingly, they leave no avenues for real-time or longitudinal assessments of change in a coping system continuously adapting and developing compensatory mechanisms. We offer a new unifying statistical framework to reveal re-afferent kinesthetic features of the individual with ASD. The new methodology is based on the non-stationary stochastic patterns of minute fluctuations (micro-movements) inherent to our natural actions. Such patterns of behavioral variability provide re-entrant sensory feedback contributing to the autonomous regulation and coordination of the motor output. From an early age, this feedback supports centrally driven volitional control and fluid, flexible transitions between intentional and spontaneous behaviors. We show that in ASD there is a disruption in the maturation of this form of proprioception. Despite this disturbance, each individual has unique adaptive compensatory capabilities that we can unveil and exploit to evoke faster and more accurate decisions. Measuring the kinesthetic re-afference in tandem with stimuli variations we can detect changes in their micro-movements indicative of a more predictive and reliable kinesthetic percept. Our methods address the heterogeneity of ASD with a personalized approach grounded in the inherent sensory-motor abilities that the individual has already developed. (shrink)

The present collection of essays brings into dialogue Pier Paolo Pasolini (1922-1975) and Rainer Werner Fassbinder (1945-1982) by comparing their cultural and intellectual legacy. Pasolini and Fassbinder are amongst the last radical filmmakers to have emerged in Europe. Born in Italy and Germany, they inherited a traumatic social and political past which is reflected in their works through a number of similarly articulated and unresolved tensions: high and popular cultures, theatre, literature and cinema, ideology and narration, major and minor codes (...) of expression. The essays in this book examine the uncompromising character of Pasolini's and Fassbinder's films. Constantly oscillating between utopia and nihilism, these works invite us to reconsider subjective and collective questions which from today's perspective seem lost forever. (shrink)

Singapore, a highly affluent island city-state located in Southeast Asia, has increasingly leveraged new assisted reproductive technologies (ART) to overcome its dismal fertility rates in recent years. A new frontier in ART is preimplantation genetic testing (PGT) for polygenic risk scores (PRS) to predict complex multifactorial traits in IVF (in vitro fertilisation) embryos, such as type 2 diabetes, cardiovascular diseases and various other characteristics like height, intelligence quotient (IQ), hair and eye colour. Unlike well-known safety risks with human genome editing, (...) there are negligible risks with PGT-P, because there are no man-made genetic modifications that can be transmitted to future generations. Nevertheless, the current efficacy of using PGT-P to select IVF embryos for either increased or decreased probability of developing specific polygenic traits is still far from certain. Hence, the regulatory safeguards proposed here will be based on the assumption that the efficacy of this new technology platform has already been validated. These include: (1) restricting the application of PGT-P only for prevention of clinically relevant polygenic disease traits, (2) securely blocking patients’ access to the raw genomic DNA sequencing data of their IVF embryos, (3) validating diagnosis of polygenic disease traits in the prospective parents/grandparents of IVF embryos, and restricting PGT-P only for preventing specifically diagnosed polygenic disease traits and (4) mandating rigorous and comprehensive genetic counselling for IVF patients considering PGT-P. There is an urgent and dire need to prevent abuse of the PGT-P technique, as well as protect the interests and welfare of patients if its clinical application is to be permitted in the country. This essay examines the relationship between Americanism, the distinctive ideology of the U.S. American empire, and the predominant discourse in the age of its war on terror, and Eurocentrism, its competing ideology but nonetheless also its ally in defending the West against different "barbarian" threats. It characterizes them as two different forms of hegemonic identity politics: one based in the idea of the particularity of culture, and the other on the idea of universality. A different form of discourse based on (...) the struggles of the traditional targets of those two ideologies is proposed here as an alternative basis for a different historical projectcentered on the idea of decolonization. RESUMENMe propongo examinar críticamente la analogía entre selección natural y condicionamiento operante que Fodor y Piattelli-Palmarini utilizan para sostener que los mismos argumentos que desacreditan la teoría conductista desacreditan la teoría de la selección natural. Estas teorías no son independientes ni conceptual ni históricamente y, por eso, no es razonable hacer una analogía entre ambas con las intenciones que se proponen Fodor y Piattelli-Palmarini. La selección natural es una condición causal del me­ca­nismo de condicionamiento operante, motivo por el cual la (...) refutación de la teoría del condicio­na­miento no puede ser una razón para la refutación de la teoría de la selección natural. ABSTRACTIn this paper I argue against the analogy between natural selection and operant conditioning that Fodor and Piattelli-Palmarini used to argue that the same arguments that discredit the behaviorist theory discredit the theory of natural selection. These theories are not independent either conceptually or historically and, therefore, it is unreasonable to make an analogy between selection and operant conditioning that can serve Fodor and Piattelli-Palmarini's intentions. Natural selection is a causal condition of the mechanism of operant conditioning, so the refutation of the theory of operant conditioning cannot be a reason for the refutation of the theory of natural selection. This essay examines the relationship between Eric Voegelin and Leo Strauss in order to show the central themes necessary to elucidate their philosophical positions. The essay reveals the centrality of the figure of Plato as a point of departure to understand the agreement and the disagreement concerning fundamental questions (such as the way of reading ancient texts, the importance of the historical perspective or the importance of the study of the past in order to orient the modern science) which revolves (...) around the issue of the relation between revelation and philosophy. The work concludes with an identification of the common core of both thinkers that allows us to understand their differences (homogeneity or heterogeneity of reality and the human) and, moreover, identifies both perspectives with a «foundational» (Voegelin) or «negative» (Strauss) interpretation of Plato’s thought. Le but de ce travail est d’examiner l’incidence philosophique de la gravitation quantique sur le concept de temps. Je cherche à montrer qu’elle conduit à une disparition du temps comme dimension et ouvre la voie à une compréhension du temps comme variation et même à l’idée de variation pure. En l’absence de temps mécanique, il est cependant possible de définir un temps d’origine thermodynamique. Je montre en quoi cette dissociation du temps mécanique et du temps thermodynamique, fait écho à l’ambivalence (...) — qui est au cœur de la physique comme de la philosophie — entre le devenir et le temps comme mesure du changement. Biomedical research recruitment today focuses on including participants representative of global genetic variation—rightfully so. But ethnographic attention to practices of inclusion highlights how this agenda often transforms into “predatory inclusion,” simplistic pushes to get Black and brown people into genomic databases. As anthropologists of medicine, we argue that the question of how to get from diverse data to concrete benefit for people who are marginalized cannot be presumed to work itself out as a byproduct of diverse datasets. To actualize the (...) equitable translation of genomics, practitioners need to place the impacts of ancestral genetic difference in the scope of much more impactful social determinants. For this to happen, multidisciplinary expertise needs to be leveraged, and current, structurally unequal health care systems ultimately need to transform. As modest steps toward this goal, new models for benefit‐sharing must be developed and implemented to mitigate existing inequality between data donors and the entities profiting from that data. In medical ethics, a large body of work exists on the virtues that enable good medical practice. Medical virtue ethics singles out a number of virtues of the good doctor for attention; among others, these include empathy, care, truthfulness, and justice. According to medical ethicists like Pellegrino and Thomasma, however, phronesis, or “practical wisdom,” occupies a special place among these virtues. For Pellegrino and Thomasma, phronesis is “indispensable” to good medical practice, because it coordinates all the different moral virtues that (...) the doctor must bring to ethical decisions as part of wise moral action.... Dans la littérature contemporaine, plusieurs philosophes se sont demandé s’ils entraient dans la catégorie traditionnelle de l’art. Une autre façon de considérer la chose, qui ne présuppose aucune définition de l’art, consiste à appréhender la forme artistique particulière à laquelle appartiennent les œuvres vidéoludiques. This article discusses the debate about vaccination as a case of public scientific technological controversy. In the vaccination controversy there is a scientific question, the effectiveness of vaccines in the elimination of diseases; a question of risk assessment, possible adverse effects and the possibility that immunization causes idiopathic diseases; an ethical question, the balance of rights between the two groups and the limits of the freedom of choice of treatment; and a political issue, who must take decisions about immunization and (...) whether immunization should be mandatory. The results of the analysis of the controversy suggest that the attitudes of the anti-vaccination groups towards vaccination are largely explained by their worldview which comes majorly from New Age beliefs. This worldview causes differences in the interpretation of evidence, law, risk and science. (shrink)

The article aims to base the presence of a reconceptualization of the political in Michel Foucault's thought, taking as the reading key ethhopolitics as a conceptual proposal. There, we can find a concept completely opposed to the way in which both modern governmentality and the tradition of political thought have understood the meaning of politics in the West. Following this purpose, the hypothesis is proposed and developed, according to which the analytical gesture that persists in Michel Foucault's thought is a (...) concept of the political that affirms life in its radical exuberance and unfoundedness. In this statement, we recognize the signatures of a triangular conceptual structure made up of the fold between life, ethics and power. After exposing the problem and clearing some methodological difficulties for its approach, we examine in detail the investigations that comprise the archeology of ethical life in the French philosopher. It is argued that the very textuality of ethhopolitics is formulated as politicity rather than as a specific policy, that is, it is presented as a politics of life, since it is implied as a singular modulation of existence. The article concludes with a scriptural threshold composed of five theses that attempt to expand and project the philosophical-political returns of the analysis developed towards a research program.
